Cancellation Policy

All trips must be paid in full at the time of booking. Cancellations are subject to a 6% non-refundable processing fee. 14+ Days Notice: 100% refund of the total booking (minus 6% fee). 7–14 Days Notice: 50% refund of the total booking (minus 6% fee). Under 7 Days: No refund will be issued. Weather Cancellations: If the Captain cancels due to unsafe conditions (e.g., lightning, high winds), you will receive a full credit to reschedule. "Less than perfect" weather (light rain​​/​​clouds) does not qualify for a refund.

Full Payment at Booking: To secure your date, 100% of the rental fee plus the non-refundable platform fee is due at the time of booking

Owner's Terms

Boat Rental & Charter AgreementBy completing this booking and payment, you (the "Guest") agree to the following terms on behalf of yourself and all passengers in your party.1. Vessel Operation, Authority, & SafetyCaptained Rentals: The designated Captain maintains absolute, total discretion regarding the safety and navigation of the vessel.Renter-Operated Rentals: The Guest acts as the sole designated Operator and assumes total physical command of the vessel.Operator Qualifications: For non-captained rentals, the Guest certifies they possess a valid state-issued boater education card if applicable.No Third-Party Pilots: Only the registered Guest may operate the boat during non-captained rentals.Immediate Termination: The Captain or Owner may terminate the trip immediately without a refund for any safety violation.Prohibited Conduct: Termination applies to illegal activity, drug use, operator intoxication, or unruly behavior endangering the vessel.Passenger Limits: Guests must strictly adhere to the vessel’s legal capacity plate.Headcount Rule: All ages, including infants, count toward the total legal passenger headcount.2. Operational Policies & Damage LiabilityStrict Timing: Your rental interval begins precisely at the scheduled start time.Late Arrival: Arriving late does not extend the trip duration or alter the return time.No-Show Forfeiture: Arrival more than 60 minutes late constitutes a no-show and results in total forfeiture of payment.Physical Damage Liability: The Guest is 100% financially responsible for all damage to the vessel caused by their party.Scope of Damage: Liability includes but is not limited to upholstery, electronic gear, structure, propeller, and lower unit.Automatic Charging: The credit card on file will be automatically charged for all required parts, labor, and salvage fees.Pre-Rental Inspection: For renter-operated trips, the Guest must inspect the hull and safety gear prior to departure.3. Liability, Assumption of Risk, & IndemnificationAssumption of Risk: The Guest acknowledges that open-water boating involves inherent, serious risks.Voluntary Acceptance: The Guest voluntarily assumes all risk of injury, death, or property damage for their entire party.Release of Liability: The Guest waives all claims against the Vessel Owner, Captain, and crew for injuries or damages.Negligence Waiver: This release explicitly includes any injuries or damages resulting from ordinary negligence.Indemnification: The Guest agrees to indemnify and hold harmless the Owner and Captain from all claims or suits.Legal Fees Coverage: Indemnification covers all losses, including attorney fees, arising from the Guest’s conduct or party.4. Governing Law, Jurisdiction, & OperationsGoverning Law: This Agreement is governed by the laws of the State of Illinois and Federal Maritime Laws.Exclusive Venue: Any legal action arising from this rental must be filed strictly in the courts of Lake County, IL.Daylight Restriction: Non-captained rentals may only operate during daylight hours between sunrise and sunset.Geographic Limits: Non-captained vessels must remain within the specific boundary lines designated by the Owner.
