PLEASE READ CAREFULLY BEFORE USING DOCKD

These Terms of Service constitute a legally binding agreement between you and Dockd, LLC. By creating an account or using the Dockd platform in any way, you agree to be bound by these terms. If you do not agree, do not use the platform.

  1. ACCEPTANCE OF TERMS

By accessing or using the Dockd platform, website, or mobile application (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. These Terms apply to all users of the Platform, including hosts (asset owners) and renters.

If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms, and “you” refers to both you and that entity.

  1. PLATFORM DESCRIPTION

Dockd is a technology marketplace platform only. Dockd provides an online venue where independent asset owners (“Hosts”) can list personal vehicles, watercraft, and residential properties for rent, and where individuals (“Renters”) can discover and book those assets directly from Hosts.

DOCKD IS NOT A RENTAL COMPANY, TRANSPORTATION PROVIDER, INSURER, REAL ESTATE BROKER, OR PROPERTY MANAGER. Dockd does not own, control, offer, or manage any listings on the Platform. All rental agreements are made directly between the Host and Renter. Dockd is not a party to any rental contract.

The Platform currently supports listings in the following categories: boats, personal watercraft (jet skis), automobiles and other vehicles, and residential homes and apartments.

  1. ELIGIBILITY

To use the Dockd Platform, you must meet all of the following requirements:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Platform under applicable law
  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials

Hosts additionally must:

  • Be the legal owner of the asset being listed, or have express authorization from the legal owner
  • Carry valid insurance coverage for the listed asset that extends to third-party rental use
  • Comply with all local, state, and federal laws governing the rental of their specific asset type
  • Hold any required permits or licenses to rent their asset in their jurisdiction

Renters additionally must:

  • Hold all required licenses, certifications, or permits required to operate the rented asset in their jurisdiction
  • Meet any minimum age or qualification requirements set by the Host
  • Provide valid government-issued identification upon request

A user may register on Dockd as a Renter, a Host, or both simultaneously within a single account. Users operating in both capacities are subject to all terms, obligations, and responsibilities applicable to each respective role for their individual transactions. A user acting as a Host n one transaction and a Renter in another is fully bound by Host terms for the former and Renter terms for the latter

  1. USER ACCOUNTS

Account Registration You must create an account to access most features of the Platform. You agree to provide accurate and complete information and to keep your account information updated. You are responsible for all activity that occurs under your account.

Account Security You are responsible for maintaining the confidentiality of your login credentials. You agree to notify Dockd immediately at support@dockd.com if you become aware of any unauthorized use of your account.

Account Verification Dockd may require identity verification, including government-issued ID, phone number verification, or other verification steps. Failure to complete verification may limit your access to Platform features. Verification does not constitute an endorsement or guarantee of any user.

One Account Per Person Each person may maintain only one account on the Platform. Users may designate their account as a Host, Renter, or both, but may not operate multiple separate accounts.

  1. HOST RESPONSIBILITIES

Listing Accuracy Hosts are solely responsible for ensuring all listing information is accurate, complete, and up to date. This includes descriptions, photos, pricing, availability, rules, requirements, and any other content. Hosts must not misrepresent their asset in any way.

Insurance Obligation Hosts must carry valid insurance coverage for their listed asset that extends to third-party rental use at all times their listing is active on the Platform. By creating a listing, Hosts represent and warrant that such coverage is in place. Dockd does not provide, arrange, or verify insurance coverage.

Legal Compliance Hosts are solely responsible for ensuring their rental activity complies with all applicable laws, including but not limited to: local zoning and short-term rental regulations, homeowners association rules, maritime regulations, vehicle registration and titling laws, income tax obligations, and any required rental permits or business licenses.

Asset Condition Hosts warrant that all listed assets are in safe, operational condition and comply with all applicable safety standards and regulations. For watercraft, this includes compliance with U.S. Coast Guard safety equipment requirements. For vehicles, this includes current registration, valid inspection, and proper working condition.

Host Contracts Hosts may establish their own rental terms, rules, and contracts with Renters. Dockd is not a party to any such agreement and assumes no responsibility for Host-created terms or their enforcement.

  1. RENTER RESPONSIBILITIES

Qualification Renters are solely responsible for ensuring they meet all qualifications required to rent and operate the asset, including any minimum age requirements, licensing, certification, or experience requirements set by the Host or required by law.

Compliance with Laws Renters must comply with all applicable local, state, and federal laws during the rental period, including traffic laws, maritime laws, boating safety laws, and any regulations governing the use of personal watercraft or residential properties.

Care of Asset Renters agree to treat all rented assets with reasonable care and to return them in the same condition as received, ordinary wear and tear excepted. Renters are liable to the Host for any damage caused during the rental period.

Assumption of Risk BY BOOKING THROUGH THE DOCKD PLATFORM, RENTERS EXPRESSLY ACKNOWLEDGE AND ACCEPT ALL RISKS ASSOCIATED WITH THE RENTAL AND USE OF THE ASSET, INCLUDING BUT NOT LIMITED TO RISKS OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS. Renters confirm they are renting and operating the asset entirely at their own risk.

Agreement to Host Terms By completing a booking, Renters agree to the Host’s listed rules, cancellation policy, and any additional terms established by the Host. Renters must review and understand all Host terms prior to booking.

  1. PAYMENTS & FEES

Platform Fee Dockd charges Renters an 8% service fee and Hosts a 3% commission on each completed booking. The renter fee is added to the Host’s listed price at checkout. The host commission is deducted from the Host’s payout. Both fees are collected by Dockd as compensation for operating and maintaining the Platform.

Payment Processing All payments are processed through Stripe, a third-party payment processor. By making or receiving payments through the Platform, you agree to Stripe’s terms of service. Dockd does not store full payment card information.

Host Payouts Hosts receive their full listed rental price, less any applicable Stripe processing fees, following successful completion of a rental. Payout timing is governed by Stripe’s payout schedule, typically 2-7 business days after booking completion.

Security Deposits Hosts may require a security deposit as stated in their listing. Security deposit terms, collection, and return are managed between the Host and Renter. Dockd is not responsible for security deposit disputes.

Cancellations & Refunds Cancellation and refund terms are determined by the Host’s stated cancellation policy (Flexible, Moderate, or Strict). Dockd’s service fees (8% renter / 3% host) are non-refundable once a booking is confirmed, except as required by law or at Dockd’s sole discretion in cases of documented extenuating circumstances.

Taxes Hosts are solely responsible for determining and fulfilling their tax obligations arising from rental income earned through the Platform. Dockd does not collect, report, or remit taxes on behalf of Hosts, except as required by applicable law.

  1. LIMITATION OF LIABILITY

DOCKD IS A TECHNOLOGY MARKETPLACE ONLY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOCKD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, LOSS, OR ANY OTHER DAMAGES ARISING FROM OR RELATED TO:

  • The condition, safety, or legality of any listed asset
  • The accuracy of any listing content
  • The conduct of any Host or Renter before, during, or after a rental
  • Any rental transaction or agreement between a Host and Renter
  • Any accident, injury, or incident occurring during a rental period
  • The adequacy of any insurance coverage held by a Host
  • Any dispute between a Host and Renter
  • Any failure of a Renter to hold required licenses or certifications

In no event shall Dockd’s aggregate liability to any user exceed the amount of platform fees paid by that user to Dockd in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, the above limitations may not apply to you, and Dockd’s liability will be limited to the greatest extent permitted by law.

  1. INSURANCE

DOCKD DOES NOT PROVIDE INSURANCE OF ANY KIND. Dockd does not offer, arrange, underwrite, or guarantee any insurance coverage for Hosts, Renters, listed assets, or any third parties.

Hosts are solely responsible for obtaining and maintaining insurance coverage appropriate for their asset and rental activity, including coverage that extends to third-party rental use. Renters should independently verify the insurance status of any asset they intend to rent.

Renters may wish to obtain their own personal liability, accident, or supplemental coverage for rental activities. Dockd makes no representation regarding the availability or suitability of such coverage.

By using the Platform, both Hosts and Renters acknowledge and agree that Dockd has no insurance obligation and that all insurance matters are the sole responsibility of the individual parties.

  1. PROHIBITED CONDUCT

Users may not use the Platform to:

  • List assets they do not own or have authorization to rent
  • Provide false, inaccurate, or misleading information in any listing or profile
  • Circumvent the Platform by completing transactions arranged through Dockd outside of the Platform to avoid fees
  • Users are strictly prohibited from sharing personal contact information including phone numbers, email addresses, website URLs, or social media handles through the Dockd messaging system for the purpose of arranging transactions outside the Platform
  • Rent assets to individuals who are under the minimum required age
  • Operate rented assets while under the influence of alcohol or controlled substances
  • Use rented assets for any illegal purpose
  • Harass, threaten, or discriminate against other users
  • Manipulate or falsify reviews
  • Violate any applicable local, state, or federal law or regulation
  • Introduce viruses or malicious code to the Platform
  • Scrape, copy, or reproduce Platform content without authorization

Violation of these prohibitions may result in immediate account suspension or termination and may expose you to legal liability.

  1. DISPUTES BETWEEN USERS

Dockd is not responsible for resolving disputes between Hosts and Renters. Any disputes arising from a rental transaction — including claims related to damage, cancellations, refunds, or conduct — are the sole responsibility of the parties involved.

Dockd may, at its sole discretion, attempt to facilitate communication between disputing parties, but has no obligation to do so and assumes no liability for the outcome of any dispute.

Arbitration Agreement Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform that cannot be resolved through good-faith negotiation shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

Class action lawsuits and class-wide arbitration are not permitted. Any claim must be brought on an individual basis only.

  1. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Dockd, LLC and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any rental transaction you participate in as a Host or Renter
  • Any injury, death, or property damage arising from a rental you arranged through the Platform
  • Any content you post or submit to the Platform
  • Your infringement of any third-party intellectual property or other rights
  1. TERMINATION

Dockd reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or conduct that Dockd determines to be harmful to the Platform or its users.

You may terminate your account at any time by contacting us at support@dockd.com. Account termination does not relieve you of any obligations incurred prior to termination, including payment of any outstanding fees.

Upon termination, your right to access and use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 8 (Limitation of Liability), 11 (Disputes), and 12 (Indemnification).

  1. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of [YOUR STATE], without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in [YOUR COUNTY], [YOUR STATE].

  1. CHANGES TO TERMS

Dockd reserves the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page and notify registered users via email. Your continued use of the Platform after notification of changes constitutes your acceptance of the updated Terms.
